Es el análisis forense hecho para que sirva ante un tribunal: adquisición de la evidencia con verificación de integridad, cadena de custodia documentada desde el primer minuto, análisis reproducible por otro perito y un informe pericial que sostiene sus conclusiones con la evidencia y no con la opinión de quien lo firma.

¿Para qué se usa?What is it used for?

Evita que la evidencia digital se caiga durante el proceso. Lo que decide si un hallazgo vale ante un tribunal no es la herramienta usada, aunque los proveedores vendan lo contrario: es la cadena de custodia y la calificación de quien firma el dictamen. Una copia forense impecable hecha por alguien que no puede sostenerla en una audiencia no le sirve de nada al abogado del caso.

It keeps digital evidence from collapsing during proceedings. What decides whether a finding holds up in court is not the tool used, whatever vendors claim: it is the chain of custody and the qualification of whoever signs the report. A flawless forensic image produced by somebody who cannot defend it at a hearing is of no use to the lawyer running the case.

¿En qué momentos es obligatorio?When is it mandatory?

Costa RicaCosta Rica

  • No hay obligación legal de contratar un peritaje: se vuelve necesario cuando hay un litigio o una denuncia de por medio.
  • En Costa Rica el dictamen se rinde ante la autoridad judicial correspondiente, y quien lo firma puede ser llamado a explicarlo y a ser contrainterrogado.
  • Si la evidencia contiene datos personales, su tratamiento sigue sujeto a la Ley 8968 y a la competencia de PRODHAB: el litigio no suspende esa obligación.
  • There is no legal obligation to commission an expert report: it becomes necessary once litigation or a criminal complaint is involved.
  • In Costa Rica the report is submitted to the relevant judicial authority, and whoever signs it may be called to explain it and be cross-examined.
  • If the evidence contains personal data, its processing remains subject to Law 8968 and the remit of PRODHAB: litigation does not suspend that duty.

Requisitos mínimosMinimum requirements

  • Acceso físico o lógico a los soportes originales, cuanto antes: cada día que pasa se pierde evidencia volátil.
  • Autorización escrita del titular del equipo o la orden judicial correspondiente. Sin eso no se toca nada.
  • Que nadie haya intentado revisar el equipo por su cuenta antes: es la forma más común de arruinar un caso.
  • Coordinación con el abogado del caso para saber qué hay que probar, porque el peritaje se diseña sobre esa pregunta.
  • Physical or logical access to the original media, as early as possible: volatile evidence is lost every day.
  • Written authorisation from the device owner or the corresponding court order. Without it, nothing is touched.
  • That nobody tried to inspect the device on their own beforehand: the most common way to ruin a case.
  • Coordination with the case lawyer to know what must be proven, because the analysis is designed around that question.

El rango habitual va de tres a ocho semanas por caso. Cae en el extremo bajo cuando hay pocos dispositivos, sin cifrado y con una pregunta acotada. Se va al alto con equipos cifrados, volúmenes grandes de correo, dispositivos móviles o nube de por medio. La adquisición de la evidencia, en cambio, es urgente y se hace en cuestión de días.

The usual range runs from three to eight weeks per case. It lands at the low end with few devices, no encryption and a narrow question. It stretches to the high end with encrypted machines, large mail volumes, mobile devices or cloud data involved. Evidence acquisition, by contrast, is urgent and happens within days.

Cadena de custodiaChain of custody
El registro de quién tuvo la evidencia, cuándo y qué hizo con ella, sin huecos. Si se rompe, la evidencia pierde valor. The gap-free record of who held the evidence, when, and what they did with it. If it breaks, the evidence loses value.

Copia bit a bit del soporte original sobre la que se trabaja, para no alterar nunca el original. A bit-for-bit copy of the original media, worked on so the original is never altered.

Huella digital de un archivo o disco. Si el contenido cambia aunque sea un bit, la huella cambia y se nota. The digital fingerprint of a file or disk. If the content changes by a single bit, the fingerprint changes and it shows.
Bloqueador de escrituraWrite blocker
Dispositivo que permite leer el disco original sin poder escribir en él, para no contaminar la evidencia. A device allowing the original disk to be read without writing to it, so the evidence is not contaminated.
